Welcome to CebuLandMarket. By accessing or using our website at cebulandmarket.com, you agree to be bound by these Terms of Service. If you do not agree, please do not use our platform.

1. About CebuLandMarket

CebuLandMarket is an online property listing platform operated by CEBULANDMARKET PROPERTY SERVICES (DTI Reg. No. 7923972), owned by Reafil B. Rusiana. We connect property sellers in Cebu, Philippines with potential buyers by publishing verified property listings on our website.

CebuLandMarket is not a real estate broker, agent, or dealer. We are a listing platform that facilitates connections between sellers and buyers. We do not own, manage, or control any listed property.

2. Eligibility

You must be at least 18 years old to use CebuLandMarket. By using our platform, you represent that you are of legal age and have the legal capacity to enter into agreements.

3. How the Platform Works

For Sellers:

• Submit a property listing through our website with complete details and photos.
• Pay a listing fee of ₱100.00 via GCash.
• CebuLandMarket verifies the property documents (title, tax declarations, ownership, photos).
• If approved, the listing is published on cebulandmarket.com and remains active until sold.
• If not approved, the ₱100.00 listing fee is fully refunded.
• Upon successful sale, the Seller pays a 1% platform fee based on the asking price.

For Buyers:

• Browse property listings for free — no account or registration required.
• Contact sellers directly through the inquiry form or messaging links provided.
• All transactions are between buyer and seller directly. CebuLandMarket is not a party to the sale.

4. Fees

• Listing Fee: ₱100.00 per property listing, payable via GCash. Refundable if the listing does not pass verification.
• Platform Fee: 1% of the Seller's asking price, payable via GCash upon successful sale of the property. Due within 7 calendar days of closing.
• Buyers: No fees. Browsing and inquiring is completely free.

5. Listing Guidelines

When submitting a property listing, Sellers must:

• Provide accurate, truthful, and complete information about the property.
• Submit authentic photos that accurately represent the property.
• Be the lawful owner or authorized representative of the property.
• Have a clean title or valid documentation for the property.
• Not list properties involved in legal disputes (unless disclosed).

CebuLandMarket reserves the right to reject or remove any listing that contains false information, violates these terms, or fails our verification process.

6. Verification Process

CebuLandMarket conducts due diligence on all submitted listings, which may include verification of:

• Land title or condominium certificate of title
• Tax declaration and tax payment status
• Property ownership and authorization
• Property boundaries, road access, and encumbrances
• Photo authenticity

Verification does not guarantee the accuracy of all information. Buyers are encouraged to conduct their own independent due diligence before making any purchase.

7. User Conduct

All users of CebuLandMarket agree not to:

• Submit false, misleading, or fraudulent information
• Use the platform for any unlawful purpose
• Harass, threaten, or abuse other users
• Attempt to circumvent the platform's fee structure
• Scrape, copy, or reproduce our listings or content without permission
• Interfere with the operation or security of the website

8. Limitation of Liability

CebuLandMarket is an online listing platform only. We do not own, manage, or have physical control over any listed property. Therefore:

• We are not liable for any accidents, injuries, property damage, loss, theft, fraud, or any incidents during property viewings or transactions.
• We are not liable for disputes between buyers and sellers, including property condition, boundaries, ownership, or payment issues.
• All property viewings and transactions are at the sole risk of the parties involved.
• We make no guarantees that any property will be sold. Listing does not guarantee a sale.
• We are not responsible for the actions, representations, or omissions of any seller or buyer.

9. Intellectual Property

All content on CebuLandMarket, including the website design, logo, text, and graphics, is the property of CebuLandMarket Property Services. You may not reproduce, distribute, or create derivative works from our content without written permission.

Property photos and descriptions are provided by sellers and remain their intellectual property. CebuLandMarket has a license to display them on the platform for the duration of the listing.

10. Indemnification

By using CebuLandMarket, you agree to indemnify and hold harmless CebuLandMarket Property Services, its owner, and representatives from any claims, damages, losses, or expenses arising from your use of the platform, your violation of these terms, or your interaction with other users.

11. Modification of Terms

CebuLandMarket reserves the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of the platform after changes constitutes acceptance of the modified terms.

12. Termination

CebuLandMarket reserves the right to suspend or terminate any user's access to the platform at any time, for any reason, including violation of these terms.

13. Governing Law

These Terms of Service are governed by the laws of the Republic of the Philippines. Any disputes arising from these terms shall be resolved amicably. If no resolution is reached, disputes shall be submitted to the proper courts of Cebu City, Philippines.
