LANDLORD LISTING AGREEMENT
Property Listing Platform Service Agreement
This Landlord Listing Agreement ("Agreement") is executed on in Cebu City, Philippines, by and between:
CebuRentMarket, an online rental listing platform operating at cebulandmarket.com/rentals, a service by CebuLandMarket Property Services (DTI Reg. No. 7923972), hereinafter referred to as the "Platform";

WITNESSETH:
WHEREAS, the Landlord is the owner or authorized representative of a rental property and wishes to list the same on the Platform for the purpose of finding qualified tenants;
WHEREAS, the Platform agrees to publish, promote, and facilitate tenant inquiries for the Landlord's property under the terms and conditions set forth herein;
NOW, THEREFORE, in consideration of the foregoing and the mutual agreements below, the parties agree as follows:
TERMS AND CONDITIONS

1. PURPOSE
The Landlord wishes to list their rental property on CebuRentMarket for the purpose of finding potential tenants. The Platform agrees to publish and promote the property listing in accordance with this Agreement.

2. LISTING FEE
There is no listing fee. Listing a rental property on CebuRentMarket is completely free. The Landlord shall not be charged any upfront cost to publish their property on the Platform.

3. PLATFORM FEE
Upon successful placement of a tenant through the Platform, the Landlord agrees to pay a one-time platform fee based on the monthly rental rate as follows:

The platform fee is a one-time payment per successful tenant placement. It is non-refundable once the tenant has been connected to the Landlord. The tenant pays nothing.

4. PAYMENT OF PLATFORM FEE
- The platform fee shall be remitted via GCash to:
- Account Name: CebuLandMarket
- The GCash number and QR code will be provided by CebuRentMarket upon successful tenant placement.
- The Landlord shall send proof of payment (screenshot of GCash transaction) to info@cebulandmarket.com.
- Payment is due before the tenant's contact information is shared with the Landlord.
- The Platform reserves the right to withhold tenant contact details until the platform fee has been received and confirmed.

5. LANDLORD'S RESPONSIBILITIES
- The Landlord shall provide accurate and truthful information about the property, including but not limited to: property type, location, rental rate, number of rooms, amenities, and condition.
- The Landlord shall respond to tenant inquiries forwarded by the Platform in a timely and professional manner.
- The Landlord shall inform the Platform within 48 hours if the property has been rented, reserved, or is no longer available for rent.
- The Landlord shall personally show the property to prospective tenants introduced through the Platform. CebuRentMarket does not conduct property viewings or accompany tenants during visits.
- The Landlord shall not redirect tenants introduced through the Platform to transact privately with the intent of avoiding the platform fee.
- The Landlord agrees to notify CebuRentMarket within 3 days of a successful rental. Failure to notify and pay the platform fee will result in withholding of the rental agreement and legal action under the signed confession of judgment.

6. PLATFORM'S RESPONSIBILITIES
- The Platform shall verify the Landlord's property details and documents before publishing the listing.
- The Platform shall publish and maintain the Landlord's listing in good faith.
- The Platform shall forward tenant inquiries to the Landlord via the contact information provided.
- The Platform shall keep all Landlord documents and personal information confidential and shall not share them with unauthorized third parties.

7. TERMINATION
- The Landlord may request removal of their listing at any time by contacting the Platform at info@cebulandmarket.com.
- The Platform reserves the right to remove any listing that violates these terms, contains false or misleading information, or is no longer available for rent.
- If a tenant is successfully placed while the listing is active, the platform fee obligation remains in effect regardless of whether the listing is subsequently removed.

8. NON-CIRCUMVENTION
- The Landlord agrees not to circumvent the Platform by directing tenants introduced through the Platform to transact privately to avoid the platform fee.
- Any tenant who first discovers the property through the Platform shall be considered a Platform-introduced tenant, and the applicable platform fee shall apply to any rental agreement with such tenant within twelve (12) months from the date of first inquiry.
- This clause survives the termination or expiration of this Agreement.

9. BREACH AND REMEDIES
- Failure to remit the platform fee or violation of any provision of this Agreement shall constitute a breach.
- Non-Payment Penalty: If the Landlord fails to pay the platform fee within the prescribed period, the amount owed shall automatically be doubled (200% of the original platform fee), plus all reasonable legal fees, collection costs, and attorney's fees incurred by the Platform in pursuing recovery. This penalty shall apply regardless of whether the non-payment is due to intentional circumvention or neglect.
- In case of breach, the Platform may:
- Remove all of the Landlord's listings from the Platform
- Prohibit the Landlord from listing future properties
- Pursue legal remedies under Philippine law to recover the unpaid fee, including the doubled penalty amount and all associated legal costs
- Report the matter to relevant authorities if necessary

10. LIMITATION OF LIABILITY
- CebuRentMarket is an online listing platform only. The Platform does not own, manage, or have physical control over any listed property.
- The Platform shall not be held responsible or liable for any disputes, claims, damages, losses, injuries, or obligations arising between the Landlord and any tenant, including but not limited to: non-payment of rent, property damage, lease violations, or personal disputes.
- The Platform shall not be held responsible or liable for any accidents, injuries, deaths, property damage, theft, loss, or any other incidents that may occur during property viewings, move-in, move-out, or at any time during the tenancy. The Landlord assumes full responsibility for the safety of the property and all persons present during viewings and occupancy.
- All property viewings and rental transactions are conducted at the sole risk of the parties involved. The Landlord and tenant are each responsible for their own safety and due diligence. CebuRentMarket and CebuLandMarket are not parties to any viewing, transaction, or lease arrangement.
- The Platform makes no warranties or guarantees regarding the successful rental of any property. Listing a property does not guarantee that a tenant will be found.
- By using the Platform, the Landlord agrees to hold CebuRentMarket harmless from any and all claims, damages, losses, or expenses arising from the listing, viewing, or rental of the property.

11. GOVERNING LAW
This Agreement shall be governed by the laws of the Republic of the Philippines. Any disputes arising from this Agreement shall be settled amicably between the parties. If no resolution is reached, the dispute shall be brought before the proper courts of Cebu City, Philippines.

12. ENTIRE AGREEMENT
This document constitutes the entire agreement between the Landlord and the Platform regarding the listing of the rental property. Any amendments must be in writing and agreed upon by both parties.
