Welcome to CebuRentMarket. By accessing or using our website at cebulandmarket.com/rentals/, you agree to be bound by these Terms of Service. If you do not agree, please do not use our platform.

1. About CebuRentMarket

CebuRentMarket is an online rental listing platform operated by CEBULANDMARKET PROPERTY SERVICES (DTI Reg. No. 7923972), owned by Reafil B. Rusiana. We connect property owners (landlords) in Cebu, Philippines with potential tenants by publishing verified rental listings on our website.

CebuRentMarket is not a real estate broker, agent, or dealer. We are a listing platform that facilitates connections between landlords and tenants. We do not own, manage, or control any listed property. All rental agreements are between the landlord and tenant directly.

2. Eligibility

You must be at least 18 years old to use CebuRentMarket. By using our platform, you represent that you are of legal age and have the legal capacity to enter into agreements.

3. How the Platform Works

For Landlords:

• Submit a rental listing through our website with complete details and photos.
• Listing your rental property is FREE — no listing fee required.
• CebuRentMarket verifies the property (ownership, existence, photos, lease terms).
• If approved, the listing is published on cebulandmarket.com/rentals/ and remains active until rented or removed by the landlord.
• If not approved, we will inform you of the reason so you can fix the issue and resubmit.
• Upon a successful rental deal facilitated through our platform, the Landlord pays a platform fee.

For Tenants:

• Browse rental listings for free — no account or registration required.
• Contact landlords directly through the inquiry form or messaging links provided.
• All rental agreements are between landlord and tenant directly. CebuRentMarket is not a party to the lease.

4. Fees

• Listing Fee: FREE. There is no cost to list a rental property on CebuRentMarket.
• Platform Fee: Charged to the landlord only upon a successful rental deal facilitated through CebuRentMarket. The fee amount will be agreed upon before the listing is published.
• Tenants: No fees. Browsing and inquiring is completely free.

5. Rental Listing Guidelines

When submitting a rental listing, Landlords must:

• Provide accurate, truthful, and complete information about the rental property.
• Submit authentic photos that accurately represent the current condition of the property.
• Be the lawful owner or authorized representative of the property.
• Disclose the monthly rent, required deposits, and any additional fees (utilities, association dues, etc.).
• Not list properties involved in legal disputes (unless disclosed).
• Not misrepresent the condition, amenities, or features of the property.

CebuRentMarket reserves the right to reject or remove any listing that contains false information, violates these terms, or fails our verification process.

6. Verification Process

CebuRentMarket conducts verification on all submitted rental listings, which may include:

• Property ownership or authorization verification
• Confirmation that the property exists and is available for rent
• Photo authenticity review
• Lease terms clarity (rent amount, deposit, duration)
• Dispute and encumbrance checks
• Utilities confirmation (electricity, water, internet availability)

Verification does not guarantee the accuracy of all information. Tenants are encouraged to visit the property in person and conduct their own due diligence before entering any rental agreement.

7. User Conduct

All users of CebuRentMarket agree not to:

• Submit false, misleading, or fraudulent information
• Use the platform for any unlawful purpose
• Harass, threaten, or abuse other users
• Attempt to circumvent the platform's fee structure
• Scrape, copy, or reproduce our listings or content without permission
• Interfere with the operation or security of the website

8. Limitation of Liability

CebuRentMarket is an online listing platform only. We do not own, manage, or have physical control over any listed property. Therefore:

• We are not liable for any accidents, injuries, property damage, loss, theft, fraud, or any incidents during property viewings or rental periods.
• We are not liable for disputes between landlords and tenants, including property condition, deposits, rental payments, lease terms, or eviction issues.
• All property viewings and rental transactions are at the sole risk of the parties involved.
• We make no guarantees that any rental property will find a tenant. Listing does not guarantee occupancy.
• We are not responsible for the actions, representations, or omissions of any landlord or tenant.

9. Intellectual Property

All content on CebuRentMarket, including the website design, logo, text, and graphics, is the property of CebuLandMarket Property Services. You may not reproduce, distribute, or create derivative works from our content without written permission.

Property photos and descriptions are provided by landlords and remain their intellectual property. CebuRentMarket has a license to display them on the platform for the duration of the listing.

10. Indemnification

By using CebuRentMarket, you agree to indemnify and hold harmless CebuLandMarket Property Services, its owner, and representatives from any claims, damages, losses, or expenses arising from your use of the platform, your violation of these terms, or your interaction with other users.

11. Modification of Terms

CebuRentMarket reserves the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of the platform after changes constitutes acceptance of the modified terms.

12. Termination

CebuRentMarket reserves the right to suspend or terminate any user's access to the platform at any time, for any reason, including violation of these terms.

13. Governing Law

These Terms of Service are governed by the laws of the Republic of the Philippines. Any disputes arising from these terms shall be resolved amicably. If no resolution is reached, disputes shall be submitted to the proper courts of Cebu City, Philippines.
